Clip-Art Licensing Agreement
Mapmobility Corp. grants you (where "you" means jointly the purchaser, and the purchaser's company/employer if the product is purchased on behalf of a company or employer) a non-exclusive, non-sub-licensable limited right to use the clip art Maps, images, derivatives or copies (collectively called the "Maps") obtained from Mapmobility on your personal computer.
The Maps may be installed for use and modification on a single computer only.
The Maps may be used on a worldwide and perpetual basis as part of:
- Advertising and promotional materials.
- On-line or electronic distribution systems including web page
design and broadcasting.
- Any products, including products for sale, or publications
in electronic or print media.
- Materials for personal, noncommercial, test and sample uses.
Except as specifically provided for herein, the Maps may not be shared or copied. Pornographic, scandalous, defamatory, immoral or otherwise unlawful use of the Maps is prohibited. Use of the Maps in a manner which suggests Mapmobility's association with or endorsement of any product, service or prejudicial belief or opinion is also prohibited.
The Maps may not be sublicensed, resold or otherwise made available for use or distribution independently of a product or use outlined above. For example, a Map may be used as part of a web page, but the Map may not be made available for downloading separately or in a format designed or intended for permanent storage, editing or reuse by the web site visitors. Similarly, clients may be provided with copies of the Maps as an integral part of a work or product, but may not be provided with the Map separately.
The copyright notice appearing on the Maps may not be altered or removed without permission from Mapmobility.
Mapmobility takes great care to ensure the accuracy and completeness of the contents of the Maps. No responsibility can be accepted for any mishap or damages arising from any inaccuracies. Mapmobility welcomes any advice on inaccuracies or omissions on the Maps.
All rights to the Maps are owned by Mapmobility and its licensor and are protected by Canadian and international copyright laws. Mapmobility and its licensor retain all rights not expressly granted in this agreement. The Maps are licensed only to you.
This License may be transferred to another person or legal entity (the "Transferee") provided that the transferee agrees to be bound by the terms of this License, and you destroy all copies of the Maps in your possession upon transfer and cease utilizing the Maps in future in any manner.
The License contained in this Agreement will terminate automatically without notice from Mapmobility if you fail to comply with any provision of this agreement.
